PRACTICE AREAS: Estate planning, administration
of trusts and estates, probate litigation, guardianships,
special needs trusts, charitable giving, Federal estate and
gift taxation, state inheritance taxation, income taxation
of estates and trusts, and the income taxation of corporations,
partnerships, and limited liability companies.
BIOGRAPHY
Robert A. Stewart joined the law firm of Lamm Rubenstone as
“Of Counsel” in 2010 specializing in estates and trusts. In
addition to working for several law firms, he previously held
a number of management positions in the financial services
industry as well as being a co-founder of the law firm of
Rabil, Kingett & Stewart based in New Jersey. A long time
resident of Philadelphia where he resides with his wife Michele
and their three sons, Mr. Stewart offers tax advice and his
services as an attorney to residents who cannot afford a tax
lawyer through Philadelphia Volunteers for the Indigent Program
(Philadelphia V.I.P.)
EXPERIENCE
Mr. Stewart began his legal career in 1983 with the New Jersey
law firm of Myers, Matteo, Rabil & Norcross where he was
the principal author of that firm’s tax opinions covering
a number of transactions including oil and gas partnerships,
research & development credits, along with the acquisition,
dissolution, and merger of businesses. His interest in estates
grew out of his experience with owners of family businesses
who sought to transfer ownership of the business to the next
generation of family members or to key employees and the desire
of those owners to protect the assets they had accumulated
over a lifetime. Dealing with the complexity of the federal
estate tax laws and the income tax consequences of such transfers
soon paled in significance to the challenges of protecting
the client’s assets from creditors, the consequences of a
son’s or daughter’s divorce, poor judgment, or illness. While
estate and inheritance taxes still play a significant role
in estate planning, for the last ten years Mr. Stewart’s estates
work is now most often driven by a client’s desire to protect
assets left to a surviving spouse, children, and grandchildren
and to assure that those assets play the most beneficial role
possible in the lives of the client’s heirs.
